Execution and cure
A judgment of the Court binds every organ. Where an organ fails to execute one, the Court appoints a person to accomplish it at the expense of the organ in default.
Article 232(1): no organ may refuse, delay or condition the execution of a judgment, and a refusal is an offence under Article 229.
Article 232(2): no measure may remove a pending case from the court seised of it, alter the composition of a court in order to affect a pending case, or annul a judgment by legislation.
Article 232(3): where an organ fails to execute a judgment, the Court orders execution, appoints a person to accomplish it at the expense of the organ in default, and declares the personal liability of those responsible.
Cure periods now running
The Court declares an incompatibility, states the provisions affected, states what would cure them, and fixes the period within which the Assembly is to act. Article 222(2) runs that period for twelve months at the most, extensible once by six months upon reasoned application showing the cure under way.
Declarations of incompatibility outstanding, at 26 July 2026
Cure under way. Amending bill lodged 4 July 2026.1.8 of 9 months
No amending bill lodged.7.2 of 12 months
Extension of six months applied for under Article 222(2).11.4 of 12 months
Period expired. Provision ceased to have effect under Article 222(4).14.0 of 12 months
When a period expires
The provision on training places reached the end of its twelve months with no amending bill lodged. The provision ceased to have effect, and the allocation of places now proceeds under the general law. The Court adopted no substitute provision, since Article 230(3) excludes any legislative function.
The provision on the transport federation is at eleven months and four weeks, with an extension applied for under Article 222(2). An extension is granted upon a reasoned application showing that the cure is under way, and the application and the decision are both published.

Offences against the constitutional order
Article 229(1): usurpation under Article 3(3), ecocide under Article 20(5), falsification of ecological or planning data, breach of Article 201, and the appropriation of public resources are tried by the ordinary courts under Title VIII.
Article 229(2): an office, a mandate or an instruction from a superior in no case exonerates the author of such an act.
Article 229(3): prosecution of usurpation is subject to no limitation of time.
A refusal to execute a judgment of the Court falls within that provision. The trial belongs to the ordinary courts, and the file reaches them through the prosecution service, which decides under Article 226 and states reasons.
