Licence RF-21/2026-09
The conditions on which this company operates
A foreign company trades in the Republic on a revocable public licence and on no other basis. The regime is new: it began with the Constitution on 7 July 2026, and this company was formed to enter it. The conditions are set out in full because the licence obliges the holder to publish them, and because counterparties ask what stands behind the supply.
What the licence permits
Purchase of concentrate from the export cooperative, sale of it abroad, and the brokerage, chartering and documentation attaching to those transactions. Occupation of a branch office at Lindoma under a terminable permission. Employment of residents on the terms the Republic fixes for any employer within its territory.
What the licence withholds
| Restriction | Effect on this company |
|---|---|
| No ownership in the Republic | The guarantees attaching to social ownership do not extend to a licensee. The company owns no mine, no mill, no wagon, no berth and no building here. What it holds at Lindoma is permission to occupy. |
| No rights under Title III | Those rights belong to natural persons. A company has none of them and pleads none of them. |
| No public function | No function of the Republic may be conferred on the company. Certification, safeguards declaration and radiological survey are all performed by public establishments. |
| No licence in the public information systems | The systems of the Republic run on free and open software whose source is public. The company supplies none of them and holds no position in any of them. |
| No arbitration | Investor arbitration cannot be compelled. Every dispute arising here is decided by the courts of the Republic under its law. |
| Burden of proof reversed | In any proceeding on the ecological budgets, the company proves that its activity conforms. The other party bears no burden of proof. |
| Limited challenge | A protective measure taken by the Republic may be challenged on procedural regularity alone, and on no other ground. |
| Transfer of technique | Technique the company brings to the trade passes into the knowledge commons. It is published, and the Republic may use it without payment and without asking. |
Duties stricter than those on domestic cooperatives
The licence imposes conditions on sourcing, disclosure, labour, ecology and reparation that go beyond what a cooperative of the Republic bears in the same trade. This is a deliberate feature of the instrument and the company took the licence knowing it.
The consequence is that compliance costs sit higher on this route than on comparable routes elsewhere, and the company prices accordingly.
Revocation
The licence may be withdrawn before its term. The grounds stated in the instrument are a failure of disclosure, a breach of an end-use undertaking by the holder or by an onward purchaser, and a finding on the ecological budgets that the holder cannot answer.
Revocation ends the right to trade at once. Concentrate already loaded is delivered under the supervision of the granting authority, contracts are assigned to the export cooperative, and the branch office closes. Fourteen licences have been applied for since July 2026 and eleven are in force. No revocation has yet been decided, the regime being several months old.
What the company tells a counterparty about this
Supply from this route rests on an instrument that the Republic may withdraw. Term contracts therefore carry a clause providing for assignment to the export cooperative on revocation, so that delivery continues even where this company ceases to trade.
A counterparty seeking a guarantee of supply independent of the licence should not contract on this route.
